February 25, 2015 - Cumberland County Prosecutor Jennifer Webb-McRae today issued a press release indicating that the she was dismissing the charges against 72-year old retired teacher and military academy graduate Gordon Van Gilder. Van Gilder made international news after being arrested and charged by Cumberland County Sheriff Robert Austino for possession of a flintlock pistol dating back to the 1700's - a "crime" carrying up to 10 years in prison under the Garden State's nonsensical gun laws. The prosecutor's press release undoubtedly came in reaction to intense public outcry as Van Gilder's story went viral. While the press release warns gun owners generally not to possess firearms in a vehicle, it states "upon careful review of the circumstances in this case, I am exercising prosecutorial discretion to dismiss the...charges in the interest of justice..." Van Gilder was stopped in November by a Cumberland County sheriff's deputy for a minor traffic violation. When he volunteered that he had a nearly 300-year-old flintlock pistol with him, he was initially released but then arrested the next morning at his home and charged with unlawful possession of a handgun, a felony. Several NJ lawmakers have introduced legislation to exempt possession of antique guns from prosecution (Assemblywoman Caroline Casagrande, Sen. Jeff Van Drew and Assemblyman Robert Andrzejczak). He's lucky he got off! There are tons of criminals and gang members running around with the same type of weapon reeking havoc all across the country. Look out next they'll be packing stick bows and spears.

Hey guys what do I know? Only spent 28 years full time in Law Enforcement in NJ 45 minutes outside of Mid-Town Manhattan! Maybe doggzoe has some news articles he would like to share with the forum? I am not trying to bust nuts, but come on? When was the last time you or anyone saw an article about gang members "reeking havoc" anywhere with an antique or modern muzzleloader? If it is not some form of semi-auto pistol they can hold side ways while grabbing onto their "package", I don't think they want anything to do with it:) Richard

NJ cops used to have a nasty trick when radar was expensive they would have one car with radar on the side of the road and then multiple chaser cars. The chaser gave the ticket even though they never observed the infraction! Yep they lied on the witness stand too and said they saw the speeder when in fact they only got the radio call to chase the car. In days gone past, especially in the South, they lied about blacks and got them hanged when they knew the white guy that did it...
There are plenty of skunks...then and now!

This case was about cops breaking the law, NJ cops do it all of the time...perhaps you sound a little bit touchy on those tactics!
The stop was probably bad from the beginning but SOP from NJ cops and it is getting worse.

Sounds more like you have something against the police Mark? We know that in all walks of life there are bad apples but you make it sound like all NJ cops are bad and I personally resent that! I had run a lot of radar and and never "fudged" a reading. The cop that busted that mans nuts had no common sense but don't make it sound like all cops are bad. There may come a day when you need one! Richard

Sounds more like you have something against the police Mark? SNIP. Only the bad ones! Unfortunately it seems the bad ones are becoming more and more prevalent. When I was a kid the cops would more than likely take a kid home to get a licking from his parents, now it is about the money and arrests.
